About denied asylum appeal withdraw

I applied for asylum in spain wich was denied on August 2023 and then i appeal RECURSO ANTE COMISOIN INTERMNISTRIAL DE ASILO Y REFUGIO
And in September 2024 i withdraw my appeal through electronic registry which i have proof justificante de presentación. In may 2025 i applied arraigo sociolaboral and Extranjería denied my application only causing that i am still in asylum process. Please help what should i do should i go for appeal with attaching the justificante de presentación of withdrawal. And is there any way can i get the resolución of my withdrawal.

Hello Barcelona1342,

If you have applied arriago sociolaboral through Disposición Transitoria 5ª because you withdrew before the 20th of May of 2025, and you meet the requirements for this residence permit, you can make an appeal and attach proof of the withdrawal and the denial of the asylum.

Remember you have to meet all the other requirements: an employment contract of a minimum of 20 hours per week, a criminal record from Pakistán, 6 months without any residence permit, and the company that hires you also has to accredit that it has sufficient financial means to pay you.

Also, you can apply for the residence through Disposición Transitoria 5ª until the 19th of May 2026, so if you didn't meet the requirements, you can make a new application.

You can obtain the resolution of the withdrawal through the procedure "Descarga de resolución de desisitimento de recurso de reposición" on this website with your digital certificate: Procedimientos y servicios

Hello, 

In that case you can make an appeal for your application of arraigo, because it seems they haven't taken into account that you had registered the withdrawal of the asylum appeal. It starts to count at the time you register the withdrawal, so with that document it has to be enough to demonstrate it.

 Maybe it is a technical problem that you can't download the resolution.

I hade submitted all the required documents like my clean criminal record from Pakistan

Contract and i am not in any regular situation till 7.9.2024 when i withdrawal my denial

Asylum appeal. This is the cause written of arraigo resolución 

CAUSAS DE DENEGACION:

* El artículo 126.a del Real decreto 1155/24 de 19 de noviembre, establece como uno de los requisitos para la concesión de

una autorización de residencia temporal por razones de arraigo, que la persona solicitante debe encontrarse en España y no

tener la condición de solicitante de protección internacional en el momento de la presentación de la solicitud ni durante su

tramitación. A tal efecto, se entenderá por solicitante de protección internacional a aquella persona extranjera que haya

formulado una solicitud de protección internacional sobre la que no se haya adoptado una resolución firme en sede

administrativa, y, en su caso, judicial. En el presente caso, el solicitante no cumple con dicho requisito, de forma que no

procede la concesión de la solicitud formulada.

And other thing when i try to download my withdrawal resolución your mentioned website it says the file number invalid although its exactly the on my asylum file.
